TERMS AND CONDITIONS OF SALE VIA THE nuggelasule.hr ONLINE STORE

1. GENERAL PROVISIONS OF THE TERMS AND CONDITIONS OF SALE

The owner of all rights on the website nuggelasule.hr is the company RONDO MONDO d.o.o. (hereinafter: Rondo Mondo). Rondo Mondo provides sales services through its service – the nuggelasule.hr online store (hereinafter: nuggelasule.hr) via the aforementioned website. By using the nuggelasule.hr service and all associated pages and services on the nuggelasule.hr domain, consumers are considered at all times to be familiar with these Terms and Conditions of Sale (hereinafter: Terms), and to fully understand and accept them. These Terms apply to the rights and obligations related to the purchase of products or services via nuggelasule.hr, and the rights and obligations arising from the conclusion of a Distance Sale Contract (hereinafter: Contract) between the consumer as the end customer and nuggelasule.hr, and are considered an integral part of such contracts.

We advise users to familiarize themselves with these Terms before purchasing and to regularly check them to be aware of all their rights and obligations.

Rondo Mondo reserves the right to change these Terms at any time without prior notice and will not be liable for any possible consequences arising from such changes. The said changes come into force upon their publication on these websites.

Rondo Mondo reserves the right to change, restrict or terminate the provision of the nuggelasule.hr service at any time without prior notice, including partially or may completely restrict access as well as the provision of certain services to users who violate the provisions of these Terms and the General Terms of Use.

The use of nuggelasule.hr services is approved exclusively for adults. The use of nuggelasule.hr by children or minors is not allowed, and parents and/or guardians are obliged to take care of this, otherwise they assume all rights and obligations arising from such use, and Rondo Mondo is not responsible for any consequences of such use.

Purchased products are used at your own risk and cannot be considered a substitute for medical or nutritional therapy.

nuggelasule.hr completely disclaims any responsibility for the accuracy and/or completeness of all information and content found on nuggelasule.hr. nuggelasule.hr reserves the right to errors in product descriptions and images.

nuggelasule.hr does not guarantee that product photos fully correspond to the appearance of the product itself. We are not responsible for possible unintentional errors in product descriptions. Differences may occur between the actual product and the product photo and the described product on these pages if the manufacturer changes any of the characteristics or content of the product. All descriptions are regularly and thoroughly checked.

2. TERMS AND CONDITIONS OF SALE

I) Conclusion and termination of the sales contract

These Terms, as well as individual terms of sale indicated with product information, constitute an offer from Rondo Mondo for the conclusion of a Contract, and the user, as the buyer, accepts them through registration, order completion, or other methods defined by these Terms, thereby concluding a Contract between the user and Rondo Mondo, according to the terms of sale outlined in these Terms.

The subject and commercial purpose of the Contract are the purchase of a selected product or service through nuggelasule.hr, with payment of the corresponding fee – the price of that product or service. The Contract is concluded by means of distance communication (a distance contract), specifically via: printed promotional messages with an order form, telephone with and without human intervention, and the Internet.

The Contract enters into force and becomes binding from the moment the user accepts Rondo Mondo's offer in one of the following ways:

• by selecting payment and completing the order as a registered nuggelasule.hr user
• by selecting payment and completing the order via 01/8877-615

a) During the registration or user account creation process, the user is obliged to choose a username or name under which they will use the services, select a security password, and provide a valid email address. All data required for registration or user account creation must be truthful, and it is strictly forbidden to use or apply someone else's data.

b) Registration or user account is created for only one person, and it is not allowed to disclose registration or user account details to third parties. The user is obliged to keep their security password and user account information confidential. The use of someone else's registration or user account is not allowed.

c) For violating the provisions of the Terms in this chapter, Rondo Mondo reserves the right, at its sole discretion, to deactivate the user's registration or user account, without any obligation to compensate the user for any costs or damages.

d) Registration (which includes payment for the service) is considered to constitute a concluded Contract between Rondo Mondo and the user as the buyer.

e) The Contract enters into force upon successful user registration, i.e., from the day the user accepts the offer to conclude such a Contract.

f) Upon conclusion of the Contract, the user will be provided with: a confirmation of the concluded Contract, i.e., the pre-contractual notice from Article 57, paragraph 1 of the Consumer Protection Act (Official Gazette, No. 41/2014), these Terms, and a notice of the user's right to unilaterally terminate the Contract with a unilateral termination form from Article 61, paragraphs 1 and 2 of the Consumer Protection Act.

g) The user may unilaterally terminate the Contract within 14 (fourteen) days without stating reasons. The user does not have the right to unilaterally terminate the Contract:

– if the service has been fully performed for them, and the performance began with their explicit prior consent and with their confirmation that they are aware that they will lose the right to unilaterally terminate the Contract if the service is fully performed for them,

– if the subject of the Contract is sealed goods which, for health or hygiene reasons, are not suitable for return if they were unsealed after delivery,

– if the subject of the Contract is goods which, by their nature, are inextricably mixed with other items after delivery,

In order for the user to exercise the right to unilaterally terminate the Contract, they must inform Rondo Mondo of their decision to unilaterally terminate the Contract before the expiration of the deadline by means of an unequivocal statement sent by mail (to RONDO MONDO d.o.o., Joze Martinovića 15, 10000 Zagreb), fax to 01/8877-608, or email to info@nuggelasule.hr, in which you will state your first and last name, address, phone number, fax number, or email address, and they may also use the specified written form for unilateral termination of the Contract.

Additionally, the user can electronically fill out and send the Form for Unilateral Termination of the Contract, in which case Rondo Mondo will promptly send them confirmation of receipt of the notice of unilateral termination of the Contract by email.

The deadline for unilateral termination of the Contract is 14 (fourteen) days from the day the goods that are the subject of the Contract were delivered to the user or a third party designated by the user, who is not the carrier, or in the case of a service, from the conclusion of the Contract.

If the user unilaterally terminates the Contract, the money received from them, including delivery costs, will be refunded without delay, and no later than 14 (fourteen) days from the day Rondo Mondo, i.e. nuggelasule.hr, receives the user's decision to unilaterally terminate the Contract, unless the user has chosen another type of delivery that is not the cheapest standard delivery offered. The refund will be made in the same way the user made the payment. In the event that the user agrees to another method of refunding the paid amount, they will not incur any costs in relation to the refund. Rondo Mondo can only make a refund after the goods have been returned to them or after proof that the goods have been sent back has been provided to them.

The user is obliged to hand over or send the goods to the address RONDO MONDO d.o.o., Joze Martinovića 15, 10000 Zagreb, without undue delay, and in any case no later than 14 (fourteen) days from the day the user communicated their decision to unilaterally terminate the Contract to Rondo Mondo, i.e., nuggelasule.hr. The user must bear the direct costs of returning the goods themselves. The user is kindly asked to call 01/8877-626 or contact info@nuggelasule.hr before terminating the Contract to have the return procedure explained.

The user is responsible for any diminished value of the goods resulting from the handling of the goods other than what was necessary to establish the nature, characteristics, and functionality of the goods.

If, at the user's request, the performance of the service began during the period for unilateral termination of the Contract, the user is obliged to pay Rondo Mondo an amount proportionate to what was delivered until the moment the user informed Rondo Mondo of the unilateral termination of the Contract.

II) Terms and conditions of purchase

The main characteristics of the products, method of use, prices, special promotions and benefits, payment methods, and delivery refer to those valid at the time of the completed order. The mentioned data will be indicated with each product.

Discounts and promotions do not combine unless explicitly stated otherwise. Promotional codes for discounts and gifts cannot be combined with each other. Promotional codes for discounts or gifts with orders have a maximum duration of 6 months from the date of publication or sending of the promotional newsletter to users, unless otherwise stated.

The price of the product, which includes the VAT amount and delivery cost, is visible in the shopping cart before completing the order. The delivery cost may also be visible in other parts of the page. All information regarding the purchase confirmation based on an electronic order will be sent to the customer's email address specified during the registration/order process or in the shopping cart when entering data during order completion. All prices are expressed in euros (EUR). All prices include VAT.

If the buyer does not receive an order confirmation notice, it is possible that they entered their email address incorrectly. PROMOTIONAL SALES AND PROMOTIONAL CODES
RONDO MONDO d.o.o. may periodically organize promotional sales of certain products. Promotional offers may be available to all customers or only to specific groups of customers (e.g., newsletter subscribers, loyalty program members, or other customer segments), depending on the terms of the individual promotion.

Promotional offers are valid for the period indicated within the individual promotion or until stocks last.

Promotional discount codes cannot be combined with each other unless explicitly stated otherwise in the terms of the individual promotion.

III) Delivery and delivery conditions

• delivery cost is calculated automatically when purchasing products and an invoice is issued to you that includes the price of purchased products and delivery price
• delivery cost will be shown in the shopping cart along with the product price
• delivery cost is communicated during ordering and depends on the selected delivery service and is charged accordingly
• the delivery time for products that are stated to be in stock, throughout Croatia, is 10-14 days from the date of the completed order, with the exception of products with a special note
• in case of a delivery deadline or any other important circumstances for the execution of the order, our customer service will immediately inform the buyer about it

IV) Complaints and grievances

Ordered products are packaged in such a way that they are not damaged by usual handling during transport/delivery. The buyer is obliged to inspect the package upon receipt. If the package has visible damage/defects, we recommend that the buyer refuse to accept it, as there is a possibility that the product inside such packaging is damaged. By refusing acceptance, the delivery service will return the shipment to Rondo Mondo, with a note that the shipment contains a defect.

In the case of a justified complaint, the contract can be terminated with a refund of the paid amount or product replacement. If there is damage and/or defect of the delivered goods, the buyer should send a photo of the said complaint so that it can be accepted based on physical evidence. nuggelasule.hr collects the complained damaged, defective or wrongly delivered goods at its own expense, if it is determined that the complaint is justified and that the buyer did not influence the defectiveness, damage or any other deficiency of the goods. In the case of a justified complaint, the cost of replacing the product with a new one is entirely borne by nuggelasule.hr.

In case of a dispute about the justification of the complaint and/or the manner in which the product was returned (the product must be unused, in an unaltered quantity and in its original packaging, with the original invoice and warranty, if any), the product will be submitted for expert assessment to an expert or a qualified legal entity. If the expert assessment confirms the justification of the complaint, all costs of product replacement will be borne by nuggelasule.hr, and in case of an unjustified complaint, the cost will be borne by the buyer.

V) Warranty for product correctness and service

Products for which we provide a warranty in accordance with the law and the manufacturer's warranty come with a warranty card. The right to use the warranty is exercised by presenting the invoice and warranty card. The buyer is obliged to keep the warranty card and the invoice. The date of issue of the invoice is the date of activation of the warranty. The product description includes information on the period for which the warranty is provided for a particular product.

In the event of a warranty card being issued by the manufacturer guaranteeing the correctness of the product for a certain period, the buyer may, if the product is not correct, request that the product be repaired within a reasonable period, or that another correct product be delivered to them instead of repair. If a product defect occurs during the warranty period, it is delivered to the authorized service specified in the warranty card.

The right to claim warranty is exercised solely by presenting the invoice. The buyer is obliged to keep the warranty card and the invoice. Product defects resulting from improper use and/or non-compliance with instructions are not covered by the warranty. Servicing and sale of spare parts for the purchased product are provided through authorized service centers listed on the warranty card.

The warranty does not exclude the seller's liability for material defects in the product.

The deadline for complaints in case of material defects of the product is 2 years.

VI) Payment method and procedure

Payment for the product price and delivery costs can be made in the ways listed in the section  Payment and Delivery Methods. 

Proforma invoice payment is only possible for legal entities. Legal entities have the option to pay by proforma invoice. After confirming the order, nuggelasule.hr sends a proforma invoice to the buyer's email address. Upon receipt of payment in accordance with the proforma invoice, the delivery process begins. 

3. DATA PROTECTION DURING PURCHASE

nuggelasule.hr undertakes to respect the anonymity and privacy of nuggelasule.hr users and will use and process data solely for the purpose and intent specified in these Terms. nuggelasule.hr may collect users' personal data, such as name, address, OIB, phone number, or email address, only if the user voluntarily provides them to nuggelasule.hr.

nuggelasule.hr will use the aforementioned data exclusively for the purpose of fulfilling contractual obligations and for a better understanding of individual needs, habits, and requirements of users, as well as for further development and improved provision of all nuggelasule.hr services. nuggelasule.hr collects, processes, and publishes data about users related to the use of nuggelasule.hr without revealing the identity of users and/or personal data that enables the identification of users.

nuggelasule.hr collects and records data about the user's IP address (Internet Protocol Address) or the computer's location for the purposes of system administration, troubleshooting, confirmation of content download, or improving the technical aspects of the internet service. nuggelasule.hr will automatically record data about user habits on nuggelasule.hr, including a log file of visits to certain pages and/or content. nuggelasule.hr will use such data exclusively for the purpose of improving its service and adapting and individualizing promotional activities to the needs of each user.

4. nuggelasule.hr COMMUNICATION WITH USERS

By purchasing products on our site, you agree that nuggelasule.hr may notify you by email about changes or additions to site content, discounts, promotions, products, or changes in service provision for the purpose of promoting services and products. The user may withdraw this consent at any time.

ALTERNATIVE CONSUMER DISPUTE RESOLUTION (ADR)

From February 15th, across the entire European Union, you have the right and the opportunity to resolve online purchase disputes in just a few clicks on these pages. The European Commission has designed a platform for such dispute resolution that will be available to all citizens of the European Union.

The platform is intended for alternative (out-of-court) resolution of domestic and cross-border disputes arising from sales contracts or service contracts between traders established in the Republic of Croatia and consumers residing in the European Union (hereinafter: EU) in proceedings before bodies for alternative consumer dispute resolution (hereinafter: ADR bodies) that are authorized to conduct mediation or issue non-binding or binding decisions on the dispute.

When consumers and traders submit a complaint, dispute resolution bodies will act as intermediaries between the two parties to resolve the issue.

Once an agreement is reached on who will resolve the dispute, the platform automatically forwards the dispute to that body, which is obliged to resolve the dispute within 90 days, entirely online.

NOTICE ON THE MANNER OF SUBMITTING CONSUMER COMPLAINTS

Pursuant to Article 10 of the Consumer Protection Act (Official Gazette 41/14, 110/15), we inform consumers that complaints regarding a purchased product or service can be submitted in writing at our business premises, whereupon we will promptly provide written confirmation of receipt of the complaint.

The merchant undertakes to respond to complaints in writing within 15 days from the date of receipt of the complaint.
